1. What We Do

The services provided by My ESA MD are available through our website located at https://myesamd.com.   Myesamd.com is an online telemedicine portal that enables participating medical practitioners and providers ( “Healthcare” or “providers”) to connect with their patients online ( “patients”) to offer Emotional Support Animal (ESA) services (and related products) via telephone and video calls.

We provide our services for patients residing in all states and territories of the United States of America. It is the responsibility of the patient to indicate which state and country the ESA letter is needed for.  It is the responsibility of the patient to use ESA letter legally.  An ESA letter provided by this company is lawfully accepted only in the United States of America and its territories.

OUR TELEHEALTH OFFICE IS NOT EQUIPPED FOR EMERGENCY SITUATIONS. IF YOU ARE EXPERIENCING A MENTAL OR MEDICAL HEALTH EMERGENCY OR IF YOU NEED MORE ADVANCED TREATMENT OR CARE, please call 911 IMMEDIATELY or visit your nearest emergency room.

Our services provide access to particular medical information and enable patients to interact with medical practitioners. However, our services are not intended to replace medical advice. We advise our patients to visit a doctor or qualified medical professional to address any mental or emotional illness questions. We do not encourage or condone waiting to get medical advice from a qualified physician. Any content published on the website https://myesamd.com should not be interpreted as medical advice or treatment. It is recommended you contact your physician to discuss any possible diagnosis, therapy, and other treatment options available for you.

There are certain limitations of telemedicine, including but not limited to the fact that we cannot conduct physical exams and must rely on a patient’s verbal communication.

By using our website, you are consenting to a telemedicine visit. You agree to answer all questions our ESA counselors and physicians ask you honestly and to the best of your ability.

2.  Future Changes to Terms and Conditions

My ESA MD reserves the right to edit, update, add or delete the items contained in these terms and conditions of use at any time.  We will provide notice of any updates on our website. By continuing to use this site after My ESA MD has provided notice of updated terms and conditions, you automatically agree to the updated terms and conditions of use.  If you do not agree to the updated terms and conditions, you should not use the website.

My ESA MD retains the right to make changes to the site or services without notice at any time. If you have any objections to any of the changes made to the site or services, you retain every right to stop using them. Your continued use of the service or the site represents that you agree with all changes. We also reserve the right to terminate the website’s operation and any service at any time without prior notice. We are not liable to our customers or any third party.

3. The Patient’s Responsibilities

By agreeing to be a patient on this site, you acknowledge that the use of services and your relationship with the physician or medical professional are performed exclusively at your own risk.  My ESA MD will not be accountable for any medical errors or substandard care a healthcare professional may make or provide.

My ESA MD is not responsible or accountable for the procurement or care of your Emotional Support Animal.

4. Confidentiality

While using our site and services, we may collect information about you. For example, you may be asked to submit your name, contact number, email, and mailing address. We will not sell or forward your personal information to any third party. My ESA MD and all providers and counselors associated or working with the company comply with all applicable federal healthcare privacy and security laws and maintain safeguards to protect the security of your health information on behalf of and in cooperation with your Provider. Additionally, the information you make available to your Provider during a consultation for Telemedicine Services is confidential, to the extent protected by applicable laws. We devote a considerable amount of time and effort toward ensuring that all of your personal account and health information communicated through the Platforms and Services is secure. In addition, All use of data is processed in accordance with our privacy policy and is protected by the HIPAA compliance laws.

5. General Provisions Regarding the Use and Age Limit

You must be at least 18 years of age to use this site and its services. Individuals under 18 years are advised to use the site with the consent of their parents or legal guardians.  

If you register as the parent or legal guardian on behalf of a child, you will be fully responsible for complying with the stated Terms and conditions. 

If you violate any of these conditions,  we will automatically terminate any recommendations and ask you to destroy any printed or downloaded materials.

6. Visitors 

As a visitor, you are free to browse this website and review the services and products available on the site. You are not required to register with the website of My ESA MD to browse the site and view any information available.

7. Fees and subscription

If applicable, any patient utilizing myesamd.com services agrees to pay all charges or fees according to My ESA MD conditions. If, for any reason, you fail to submit the payment via a debit or credit card is declined, the site https://myesamd.com reserves the right to terminate or suspend any services provided immediately. If you want to regain access to the services again, you will have to contact us directly.

8. Unauthorized Activity.

By using this website and/or our services, you agree not to:

· Use racially, ethnically, or otherwise offensive language.

· Harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate any other patients or counselors or health care providers based on gender, gender identity, sexual orientation, religion, ethnicity, race, age, national origin, or disability and any other reason

· Discuss or incite illegal activity.

· Use explicit/obscene language or post or send sexually explicit images (actual or simulated) with any other patient, counselor, or health care provider.

· Place any trademarked or copyrighted materials without giving credit or taking permission from the owner.

· Disseminate any unsolicited or unauthorized advertising, promotional materials, “spam,” “spam,” “chain letters,” “pyramid,” or any other similar materials.

· Use robots, spiders, or other automated means to access the site.

· Defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights (such as rights of privacy and publicity of others.)

· Change opinions and comments posted on this site.

· To post anything contrary to our image and reputation.

9. Communication

You agree to allow us to text, email, or call you to remind you of appointments, fees, renew your ESA letter, or send you other relevant offers.

10. Ownership.

Myesamd.com is owned by My ESA MD in the United States. Other trademarks, names, and logos on the site are the property of their respective owners.

11. Liability

My ESA MD, its employees, counselors, and heath care providers are not liable or responsible for any legal fees, damages or expenses that may result from any in appropriate behaviors or actions of an Emotional Support Animal.  These Terms and Conditions release My ESA MD, it employees, counselors and health care providers from all liability relating to injuries, property damage, or emotional distress incurred due to the behaviors and actions of an Emotional Support Animal, regardless of owner negligence.  We support the use of muzzles on animals that become anxious around new people or unfamiliar environments.  We advocate for all our patients to the very best and extent of our ability and will support you if you need to log a complaint with HUD.
