Florida is a great place to practice your rights with your emotional support animal, as a resident or vacationer.   In fact, it’s one of the best.   And now, during this cold winter season there are more ESAs in the sunny state with their snowbird owners.

If you are visiting Florida with an Emotional Support Dog, take your ESA letter with you. And prepare to have a good time with your friend. 

There are dog friendly beaches, trails and places like Dinosaur world and the Fountain of Youth in St. Augustine where you and your ESA will be welcome.  And bring your ESA letter to the hotel where you are staying. Practice your rights there too. 

Dog Friendly Restaurants in Florida

There are even dog friendly restaurants throughout Florida.  In fact, Florida was the first state to enact a law about dogs in restaurants in 2006.   It depends on the county and the restaurant, but there should be plenty of places that will be happy to service every member of the family, including your ESA.  Those restaurants that allow dogs have strict hygiene protocols to follow, so no worries.  

You shouldn’t have a hard time finding ESA friendly restaurants.  But check with the restaurant before you make your plans.

Florida Statutes on Emotional Support Animals

Florida statute regarding emotional support animals mirrors the protection provided by the Fair Housing Act.

In Florida, an Emotional Support Animal is defined as an “animal that does not require training to do work, perform tasks, provide assistance, or provide therapeutic emotional support by virtue of its presence which alleviates one or more identified symptoms or effects of a person’s disabilities.”

According to Florida statute,” if the disability that allows for a specific emotional support animal is not visibly apparent, supporting information may include information from “ a health care practitioner as defined in s. 456.001, a telehealth provider as defined in s. 456.47 or any other similarly licensed certified practitioner of provider in good standing with her or her profession’s regulatory body in another state.  Such information is reliable if the practitioner or provider has personal knowledge of the person’s disability and is acting within the scope of his or her practice to provide the supporting information.”
